Our Litigation practice provides strategic representation across commercial, constitutional, employment, land, family, insurance, criminal, and debt recovery matters, guiding clients through dispute resolution, enforcement, and court proceedings with clarity and confidence.
Our Litigation Department deals with different forms of litigation that arise during the ordinary course of business where we need to file suit on behalf of or defend any cases that are filed against our clients. These may be disputes arising out of contractual breaches, performance and interpretation of the contractual obligations and other matters where a party may feel that they need to take action in court to enforce their claims. The Firm acts for Clients through the execution and enforcement stage of various decrees.
Depending on the breach and parties’ disposition, we try to settle disputes out of court and only resort to litigation as a final resort. Amongst the value adds that we provide to our Clients include sharing strategy and opinions on proposed and ongoing litigation and a systematic structure on pretrial preparation to minimize adjournments and hasten conclusion of our matters. Over time, the department has perfected on the following areas of litigation:
1. Constitutional & Human Rights Division
There is always need for litigation to seek clarification or guidance on the meaning, interpretation and implementation of the Constitution because social and political issues keep changing or developing. The Litigation department of the Firm deals enforcement of human rights and obligations inter alia.
The department prides itself in effectively and empathetically managing emotionally unpredictable situations to ensure our client’s needs and interests are secured. with the interpretation and application of the powers, rights and freedoms established by the formally adopted Kenyan 2010 Constitution.
The Firms work work in interpretation of the Constitution encompasses the powers of the various branches of government as against the rights of the people. The firm has filed Petitions that have been key in pushing the Government to uphold the human rights and indeed perform in obligations within the purview of the Constitution.
2. Employment And Labour Relations Law
Under our Employment Law Department, we draft the various Letters of Engagement or Employment Contracts for several of our corporate clients. We also draft various policies that are required at the workplace and are also involved in Collective Bargaining Agreements that our clients may wish to enter into with any of their unionisable staff. We advise them on any breaches of employment contracts and defend them in any Civil Litigation that may arise.
We offer consultancy services on the new labour laws and other related labour legislation. We also handle employment agreement and advice on their interprentation as well as litigate on empolyment matters in court. We provide our clients with all practical, commercial, and legal solutions including employment contracts, termination and redundancy advisories and disputes, and collective bargaining advisory.
3. Environmental And Land Law
In this Department, we offer advice to developers and other property dealers as to the regulations regarding their enterprises and how best to proceed in keeping with the environmental regulations in place. We also counsel and work for major regulatory bodies as to the conduct and approach to all the legal issues touching on the environment.
We have also appeared in several instances for our clients before the National Environmental Tribunal, and handle litigation on environment and land matters touching on dispute on use, control and ownership.
Under this Department we handle the drafting and registration of leases for various landlords of commercial buildings. We liaise with property agents to ensure that the letters of offer are duly executed to enable us prepare the leases. We are also involved in the registration process to ensure that the leases are registered so as to protect our clients’ interests.
We also review lease agreements for individual clients and advise on any changes in the Kenyan Law that may affect tenancies. We are major practitioners at the Rent Tribunals where we have represented an array of clients and handled disputes with regards to interpretation of leases and disputes arising out of the leases.
4. Family & Succession Law
Our Litigation department seeks to find solutions to issues relating to often complex relationships between individuals who share a domestic connection including marriage and parenthood among others. It therefore involves work with varying groups from children to the elderly and any other in between.
Some of the issues dealt with include marriage, divorce, dissolution, division of property, child custody, There is always need for litigation to seek clarification or guidance on the meaning, interpretation and implementation of the Constitution because social and political issues keep changing or developing. Our team of Advocatesthe also deals with parental rights and obligations, adoption inter alia.
The Firm represents clients in family court proceedings as well as supervised mediation sessions to ensure the matters come to fruition. The Firm prides itself in effectively and empathetically managing emotionally unpredictable situations to ensure our client’s needs and interests are secured.

We also render our clients legal opinions on all related insurance matters including any changes to the law and on any potential liability that they may be exposed to in matters in which they have placed insurance cover.
We further negotiate on behalf of our clients with parties that have sued our insurance clients and put them to strict proof of any claims that they make against our clients with a view of reaching a settlement that leaves our clients Where necessary we take up the matters to court to obtain a final and binding position.

Under the criminal litigation, the firm represents companies and individuals in all stages of criminal and regulatory defence proceedings. We undertake cases involving serious fraud, large scale or serious crime, money laundering and other high profile criminal cases. Our aim is to mitigate on behalf of the client with a view of getting the client a favourable outcome in the criminal proceedings.
